30C. (1) Subject to the provisions of sub-article (2), where a witness, expert or other person in a foreign country consents, in respect of an offence contrary to the provisions of this Ordina nce, to give evidence in a proceeding or to assist in an investigati on, prosecution or judicial proceedin g in Malta following a request for assistance to that effect made by the competent authority in Ma lta to the competent authority in that foreign country that witness , expert or other person shall not , while in Malta, be prosecuted , detained, punished or subjected to any other restriction of his personal liberty in respect of acts, omissions or convictions p rior to his departure from the foreign country. (2) The provisions of sub-articl e (1) shall cease to apply when the witness, exper t or other person: (a) fails to leave Malta, after having had the opportunity t o d o s o , w i t h i n a p e r i o d o f f i f t e e n c o n s e c u t i v e d a y s from the date on which he has been served by the Attorney General w ith a notice informing him that his DANGEROUS DRUGS [CAP. 101. 37 presence in Malta is no longer required; or (b) having left Malta, has returned of his own free will.
