169. In the cases referred to in ar ticle 167, the sworn application shall be served on the defendant without delay; and he shall be ordered to appear not earlier than fifteen days and not later t han thirty days from the date of service: Provided that in the case of non-observance of the provisions of this article the c ourt shall not s top proceedings by special summary proceedings but shall give such orders as it ma y consider appropriate so that the rights of the parties be not prejudiced.
