Code of Organization and Civil Procedure (Cap. 12), article 414
414. If, within the time renewed as provided in the last
preceding article, the jactitator fails to institute fresh proc eedings,
the plaintiff in the jactitation suit may demand, by sworn
application before the court which fixed the original time, that
perpetual silence be enjoined on the jactitator in regard to th e claim
which he had brought for trial.
