599. The court may, according to circumstances, allow and take
into consideration any testimony on the relation of third perso ns,
where such relation has of itself a material bearing on the sub ject-
matter in issue or forms part the reof; or where such third pers ons
cannot be produced to give evidence and the facts are such as
cannot otherwise be fully proved, especially in cases relating to
births, marriages, deaths, abse nce, easements, boundaries,
possession, usage, public historical facts, reputation or chara cter,
words or deeds of persons who are dead or absent and who had no
interest to say or write a false hood, and to other facts of gen eral or
public interest or of public notoriety.
