698. (1) If the party, to whose oath reference is required, fails
to appear on the day appointed for the trial, the party referri ng
shall, upon the issues being settled, make a declaration to the effect
that he intends making such reference and shall present questio ns
and statements which shall be for mulated in an affirmative mann er
as to require an affirmative answer which shall be sealed by th e
registrar.
(2) If the party to whose oath reference is made fails to appear
on the day to which the court shall adjourn the trial of the ca use,
without good cause being shown for his non-appearance, the
questions shall be deemed to be admitted and accepted.
