760. (1) In actions concerning capital and interest, the value is determined by the aggregate am ount of capital and interest. (2) Where the plaintiff, on bei ng called upon by the court or by the defendant, refuses to state the period of time which has el apsed since he last received payment of the interest, the value in re spect of such interest shall be determined by computing the amount thereof from the time when s uch interest was agreed upon.
