865. (1) If, notwithstanding the issue and execution of a
precautionary warrant o f arrest, a ship or vessel is removed fr om
the jurisdiction of the court in breach of the warrant of arres t, the
owner, bareboat charterer or other person being in possession o f the
ship or vessel at the time of such breach shall be jointly and
severally liable to a penalty of one hundred and sixteen thousand
and four hundred and seventy euro payable to the party issuing the
warrant.
(2) The liability for the payment of a penalty arising under thi s
article shall be without prejudice to any other possible sancti on
arising under the provisions of Title XVII of Book Third of thi s
Code.
