Code of Organization and Civil Procedure (Cap. 12), article 909
909. If the party discontinuing the action desires to commence
another action for the same cause , any of the exhibits or any o ther
evidence produced by hi m in the former proceedings, shall at hi s
request be inserted in the record of the new action; and where the
new action is, or has been institu ted in another court, any suc h
exhibits or any other evidence shall, upon a demand to that eff ect
by an application, be forwar ded to such other court.
