124. Upon an adoption decree being made, the person in respect of whom the adoption decree is made shall assume the surname of the adopter: Provided that where the adopt ion decree is made in favour of two spouses, the person in respect of whom the adoption decr ee is made shall assume the surname of any of the adoptive parents , or the surname of both adoptive pare nts in the order of their choi ce: Act XXIII of 2017.Provided further that when the adoption decree is made in favou r of two spouses who contracted marri age after the coming into force of the Marriage Act and other Laws (Amendment) Act, 2017 *, then the person in respect of whom the adoption decree is made shall ass ume the Family Name of the spouses: Provided further that where the person to be adopted is a child below the age of three years, the adopter may, with the approval of the court, giv e such child a new name: Provided further that where the person to be adopted has sufficient understanding, he may choose to retain his biologica l family name and assume the surname of the adopter or adoptive parents, as the case may be, in accordance w ith the provisions of this Code .
