13. (1) The obligation of such persons as according to the order set forth in the last prec eding article are placed in the same degree of liability, s hall be a joint and several obligation. Obligation in subsidium. (2) The persons, however, who according to such order, are placed in a remoter degree shall have only a subsidiary liabili ty, if those in a nearer degree are unab le to discharge their obligati on. Power of court in urgent cases. (3) Nevertheless, it shall be l awful for the court, in urgent cases, to condemn any of the per sons liable for maintenance, in whatever degree, to supply maint enance, reserving to such perso n the right to claim reimbursement from such other persons as, according to the said order, were bound to supply such 16 [CAP. 16.
