367. (1) The provisions of the last two preceding articles shall likewise apply in the case where a building or a part of a buil ding constituting an accessory necessary for the enjoyment of the tenement subject to the usufruct, or an accessory part of the building constituting the principal subject of the usufruct, falls down through age or by a fortuitous event. (2) For determining whether the part which has fallen off the building which constitutes the principal subject of the usufruc t, is an accessory part, regard shall be had not only to the destinat ion of such part, but also to the expe nse required for reconstructing such part as against the expense which would be required for the reconstruction of the whole building. Usufructuary cannot prevent owner from carrying out repairs.
