39. Where a law suit for personal separation has been filed by either spouse, or a law suit for access, and, or, care and cust ody of children has been filed, even whe n the parents are not married, and evidence of acts of domestic vi olence has been produced, the co urt may, either on an application of one of the parties or on its o wn motion in order to protect the safety of the parties involved o r in the best interests of the child or children or of any other min or dependants of any of the spouses, issue a protection order unde r article 412C of the Criminal Code and, or a treatment order under article 412D of the same Code and the provisions of those artic les shall mutatis mutandis apply to an order issued under this article as if it were an order issued under the corresponding article of t he said Code.
