Civil Code (Cap. 16), article 430
430. Where the earth excavated for the formation of the ditch,
or the refuse accumulated therei n for a period of three years, is only
on one side of the ditch, this shall be an indication that the ditch is
not common, and the ditch is presumed to be the exclusive prope rty
of the party on the side of whose tenement the earth or the
accumulated refuse is found.
Where ditch serves
for the drainage of
the lands of one
owner only.
