The trees which are on the boundary-line between two tenements shall, in the absence of proof to the contrary, be de emed to be common; and each of the neighbours may demand that such trees be uprooted or cut if he proves that the damage they may cause to his tenement is greater than the benefit he himself ma y derive therefrom. § III.
