Civil Code (Cap. 16), article 449
449. Where the right of way grant ed as aforesaid shall, in
consequence of the opening of a n ew road, or of the incorporati on
of the tenement with another tenement contiguous to the public
road, cease to be necessary, the owner of the servient tenement may
demand the discontinuance of such right of way on restitution o f
the indemnity received or the c essation of the annual payment
agreed upon.
