Civil Code (Cap. 16), article 725

725. ( 1 ) W h e r e t h e h e i r o r l e g a t e e t o w h o m t h e r i g h t o f selection belongs, has not been able to make such selection, th e right thereof shall vest in his heir. (2) The selection, once ma de, shall be irrevocable. (3) Even where in the estate of t he testator there shall be only one of the things included in the genus or species, the heir or legatee having the right of selection, shall not, in the absenc e of an express disposition to the contrary, be entitled to select othe r than the thing existing in the estate.
