730. (1) Where the subject of the legacy is a determinate quantity to be delivered or paid at fixed periods, as every year, every month or at other periods, the first period shall commence to run from the death of the testator, and the legatee shall acquire the right to the whole quantity due for each of the periods, even though he may have been alive at the commencement only of the said period. (2) Nevertheless, the legacy unless it is by way of maintenance cannot be claimed until after the expiration of the period. (3) If the legacy is by way of maintenance, it can be claimed at the commencement of the period. Thing bequeathed to be delivered with accessories.
