745. (1) A testamentary disposition shall lapse, if the person in whose favour it is made shall not survive the testator. (2) Nevertheless, the descendant s of the heir or legatee shall succeed in his place to the inheritance or legacy whenever, in case CIVIL CODE [CAP. 16. 191 of intestacy, they would have benefited by the rule of representation, unless the testat or has otherwise directed, or unless the subject of the leg acy is a right of usu fruct, use, or habit ation, or any other right which is of its own nature personal.
