788. Where there is no valid will, o r where the testator has not disposed of the whole of his est ate, or where the heirs-institu te are unwilling or unable to accept th e inheritance, or where the rig ht of accretion among the co-heirs does not arise, intestate successi on CIVIL CODE [CAP. 16. 197 takes place, wholly o r in part, by the operation of law.
