Civil Code (Cap. 16), article 838

838. Where any person claiming rights over the property of the inheritance has taken possession thereof, the heirs in whom possession vests by law shall be deemed to have been dispossess ed de facto, and may exercise all the actions competent to a legitimate possessor.
