Civil Code (Cap. 16), article 867
867. (1) An heir who has renounced an inheritance may yet
accept such inherita nce provided -
(a) the right of acceptance shall not, in his regard, have
lapsed by prescription; and
(b) the inheritance shall not h ave been already accepted by
other heirs.
(2) Nevertheless, such acceptan ce shall not operate so as to
prejudice any right which may have been acquired by third parti es
over the property of the inherita nce either by prescription, or by
virtue of acts validly made with the curator of the vacant
inheritance.
Heir may be
compelled to
declare whether he
accepts or refuses.
