Civil Code (Cap. 16), article 908
908. When the parties do not agree upon the choice, the court
shall appoint a person to draw up a general statement of the
property, to make up the respectiv e shares of the inheritance, and to
fix what each co-partit ioner is to receive.
Presumption of the
pre-existence of
property in case of
a second or
subsequent
marriage.
