954. (1) Any such partition may be made by an instrument inter vivos or by a will, with the formalities, and under the conditions and rules prescribed for donations and wills. 218 [CAP. 16. CIVIL CODE (2) Where such partition is made by an instrument inter vivos , it may only include present property. Property not included in partition to be divided according to law.
