39. The Minister may make regulations providing for a code of practice for the audio-recording on tape or for the video-recor ding on film of any interview of a person suspected of the commission o f an offence, as may be specified in the said regulations. TITLE II PROTECTION OF WITNE SSES AND VICTIMS Witness protection.40. (1) Where a person who is the victim of a crime is to be produced as a witness in any criminal proceedings against any principal or accomplice in the crime and that person is concern ed for his safety or there exist concer ns over that person’s safety, t he Commissioner may, subject to the provisions of article 39, set up a witness protection programme hereinafter referred to in this Pa rt as "the programme". (2) The provisions of sub-article (1) shall also apply to a pers on who took part in the commission o f a crime and whose evidence i s required for the prosecution of any principal or accomplice in the crime where that person agrees to co-operate with the public authorities for the purpose of such prosecution.
