Police Act (Cap. 164), article 5
5. (1) The Government shall be responsible for the strategic
direction of the Force.
(2) There shall be a Police Governance Board composed of five
members, one of whom shall be the Chairperson, appointed by the

Prime Minister in consultation with the Minister responsible fo r the
Police, from amongst persons who have knowledge and experience in
areas such as Policing, Strategic Management, Criminology, Publ ic
Administration and Criminal Justice.
(3) The members shall hold office for a period of three years fr om
the 1st January of the year for which they are appointed and ma y be
eligible for re-appointment.
(4) The Governance Board shall meet at least once a month at the
place that may be established for such meetings.
(5) The quorum at meetings shall be of three members.
(6) The Commissioner of Police sh all attend the Board’s meetings
in an ex officio capacity and with no voting rights.
(7) If any vacancy in the Board occurs during the year on accoun t
of inability of a member of the Board to perform the functions of his
office, infirmity of mind, misbehaviour, resignation, death or for any
other cause, the Prime Minister, in consultation with the Minis ter,
shall, as soon as practicable, appoint another person to fill i n the
vacancy, and the person so appointed shall remain in office for the
remainder of the term of office:
Provided that the Board and members shall continue to act
notwithstanding such vacancy.
(8) No person shall be qualified to be appointed as, or remain, a
member of the Board if he:
(a) is a member of the House of Representatives or of the
European Parliament; or
(b) is a serving Judge or Magistrate; or
(c) is legally interdicte8.
d or incapacitated; or
(d) is convicted of an offence af fecting public trust, or of
theft or fraud, or of kno wingly receiving property
obtained by theft or fraud, or of bribery or of money
laundering, or has otherwise been sentenced to a term
of imprisonment; or

(e) is subject to disqualification under article 320 of the
Companies Act ; or
(f) has a financial or other in terest in any enterprise or
activity which is likely to affect the discharge of his
functions as a member of the Board:
Provided that the Minister may waive the disqualification of a
person under this paragraph if suc h person declares the interes t, and
such declaration and waiver a re published in the Gazette.
(9) The Board shall have the following functions:

(a) to develop the long-term vision, purpose and direction
of the Force;
(b) to develop a long-term strategic document;
(c) to advise on any recommendation brought before it;
and
(d) to approve key organisational policies:
Provided that the strategic documents referred to in
paragraphs ( a) and ( b) shall be submitted to the
Minister for his approval.
(10) The Board shall submit an annual report of its work to the
Minister and the said report shall be laid on the Table of the House of
Representatives and shall be dis cussed in not more than one sit ting
within six months from the said laying.
(11) The Board shall submit its strategic documents to the Minis ter
and the said strategic documents shall be submitted by the Mini ster to
the Social Affairs Committee of t he House of Representatives.
