35. (1) Notwithstanding anything in this Act or in any other law contained, but subject to any provisions made under Part II I of this Act, the Minister may also prohibit the entry into Malta o f any person who, in the opinion of the Minister, is not provided wit h suitable accommodation in the island. (2) The last preceding sub-ar ticle shall not apply - (a) to any person who is a citizen of Malta by virtue of article 22(1) or of article 25(1) of the Constitution of Malta or who is deemed to be such a citizen under article 44(4) of the said Constitution ; and (b) to any other citizen of Malta who - (i) has emigrat ed from Malta; (ii) was resident in Malta and has during the two years immediately befo re emigrating been so resident for a continuous period of one year or for periods amounting in the aggregate to one year; and (iii) returns to Malta wi thin two years after his departure therefrom.
