Merchant Shipping Act (Cap. 234), article 109
109. (1) If any person is employed in any ship in
contravention of any of the provisions of articles 106 and 108 or in
contravention of any regulations made under these articles, the
master or owner of the ship shall be liable to a fine ( multa ) not
exceeding five hundred units, or, in the case of a second or
subsequent offence, not exceeding one thousand uni ts; and where a
person under the age of sixteen years or a person under the age of
eighteen years is taken into employment in any ship in
contravention of the aforesaid provisions of this Act on the
production by, or with the privity of, the parent of a false or forged
certificate or on a fake represent ation by the parent that the person
is of an age at which such employment is not in contravention o f
the said provisions, that parent shall be liable to a fine ( multa ) not
exceeding five h undred units.
(2) If the master of a ship fails to comply with any of the
provisions of article 107, or on being so required by the Minis ter or
an officer authorised by the Mi nister in that behalf or an
appropriate inspector, or any other person having power to enfo rce
compliance with the provisions of this Act, refuses or neglects to
produce for inspection by that officer any register as is requi red to
be kept by him under the article aforesaid or any certificate
delivered to him under articles 106 or 108 or in terms of any
regulations made under these arti cles, he shall be liable to a fine
(multa ) not exceeding five hundred units.
