Merchant Shipping Act (Cap. 234), article 131
131. All wages to which a seaman m ay be entitled, subject to
deductions made in acco rdance with this Act, shall be paid befo re
or at the time the seaman lawfully leaves the ship at the end o f his
engagement; and in the event of a seaman’s wages or any part
thereof not being so paid or settled, then, unless the delay is due to
the act or default of the seaman or to any reasonable dispute a s to
liability or to any other cause not being the wrongful act or d efault
of the owner or master, the seam an’s wages shall, for the perio d the
seaman remains on board the vessel, continue to run and be paya ble
until the time of the final settlement thereof:
Provided that should the ship concerned be subject to a
judicial sale, the wages due to the seamen on board shall conti nue to
accrue in favour of the seamen who continue to carry out their duties
on board and shall continue to ac crue either until the seamen l eave the
ship or until the ship is sold, whichever is the earlier. Follo wing a
judicial sale, wages shall not continue to accrue in favour of a seaman
unless he is engaged by th e new owner of the ship.
