Merchant Shipping Act (Cap. 234), article 147
147. Where proceedings are instituted before any court in
relation to any dispute between an owner, or bareboat charterer, or
master of a ship and a seaman or apprentice arising out of or
incidental to their relation as such, or is instituted for the purpose
of this article, the court, if having regard to all the circumstances of
the case thinks just to do so, may rescind any contract between the
owner, or bareboat charterer, or master and the seaman or apprentice
upon such terms as the court may think just, and this power shall be
in addition to any other jurisdiction which the court can exercise
independently of this article.
