Merchant Shipping Act (Cap. 234), article 152
152. (1) The Minister may make regulations protecting the
health of persons on board Maltese ships and requiring Maltese
ships to carry such medicines, medical stores, equipment, facil ities,
appliances and books containing instructions and advice, as may be
specified in the regulations, an d the regulations may make diff erent
provisions for different descriptions of ships or different
circumstances.
(2) The owner, or bareboat charterer and master of every
Maltese ship shall ensure that the ship carries medicines, medi cal
stores, equipment, facilities, ap pliances and books in accordan ce
with the scales laid down under sub-article (1).
(3) Where an appropriate inspector is of the opinion that the
medicines, medical stores, equipment, facilities, appliances an d
books on a Maltese ship are deficient in quantity or quality or are
placed in improper receptacles, h e shall give notice in writing to
the master, owner, bareboat charterer, or agent of the ship, an d the
ship’s certificate of registry, w hether provisional or otherwis e, may
be suspended until the def ault has been remedied:
Provided that if the master, or owner or bareboat charterer of
the ship fails to remedy the default and comply with the
requirements of this article, the master, or owner or bareboat charterer
shall be liable to a fine ( multa ) not exceeding five hundred units
unless he proves that the non-compliance was not caused through
his inattention, negl ect or wilful default.
