Merchant Shipping Act (Cap. 234), article 244
244. (1) Where an accepted Safety Convention certificate is
produced in respect of a Safety Convention passenger ship not
registered under this Act -
(a) the ship shall not be required to be surveyed except for
the purpose of determining the number of passengers
she is fit to carry;
(b) on receipt of any declaratio n of survey for the purpose
aforesaid, the Minister ma y issue a certificate under
article 218 containing only a statement of the
particulars set out in sub-article (1)( b) of that article,
and a certificate so issued shall have effect as a
passenger ship certificate.
(2) Where there is produced in respect of any such passenger
ship as aforesaid an accepted Safety Convention certificate and also
a certificate issued by or under the authority of the governmen t of
the country in which the ship is registered showing the number of
passengers that the ship is fit to carry, and the Minister is s atisfied
that that number has been determined substantially in the same
manner as it would have been determined for the issue of a
passenger ship certificate under this Act, he may, if he thinks fit,
dispense with any survey of the ship for the purpose of determi ning
the number of passengers that she is fit to carry and direct th at the
certificate issued as aforesaid shall have effect as a passenge r ship
certificate, and thereupon that c ertificate shall have effect
accordingly.
