293. (1) All owners or bareboat charterers and masters of ships shall observe the collision regulations, and shall not carry or exhibit any other lights, or use any other fog signals, than su ch as are required by those regulations. (2) If an infringement of the collision regulations is caused by the wilful default of the master, or owner, or bareboat charter er of the ship, that master, or owner, or bareboat charterer shall for ea ch offence be liable to imprisonment for a period not exceeding tw o years or to a fine ( multa) not exceeding five hundred units or to both such imprisonment and fine. (3) If any damage to person or property arises from the non- observance by any ship of any of the collision regulations, the damage shall be deemed to have been occasioned by the wilful default of the person in charge of the deck of the ship at the time, unless it is shown to the satisfaction of the court that the circumstances of the case made a departure from the regulations necessary. (4) Nothing in sub-article (3) shall affect any liability of the owner or bareboat charterer and the master of the ship for dama ge. (5) Any person who causes an i nfringement of the collision regulations may be prohibited by the Registrar-General from bei ng engaged on a Malta registered ship, for a definite or indefinite period.
