84. All duties in relation to the survey and measurement of
ships shall be performed by surveyors of ships in accordance wi th
regulations made or instructio ns given by the Minister.

PART IIA
BAREBOAT CHARTER REGISTRATION
Interpretation.84A. ( 1 ) F o r t h e p u r p o s e s o f t h i s P a r t o f t h i s A c t , u n l e s s t h e
context otherwise requires -
"bareboat charter" means the cont ract for the lease or sub-leas e
of a ship, hereinafter referred to as charter, for a stipulated period
of time, by virtue of which the charterer shall acquire full co ntrol
and complete possession of the ship, including the right to app oint
her master and crew for the duration of the charter but excludi ng
the right to sell or mortgage the ship;
"bareboat charter re gistration" means the registration of a shi p in
a bareboat charter re gistry under the nam e of the charterer;
"bareboat charter registry" mean s the registry of the State wh ose
flag the ship is entitled to fly during the period in which the
charterer is registered as the bareboat charterer;
"compatible registry" means a ship registry of a foreign State
declared by the Minister to be a compatible registry in terms o f
article 84B;
"day" means calendar day;
"underlying registry" means the registry of the State in which the
owners of a ship are registered as owners and to which jurisdic tion
and control will revert upon termination of the bareboat charte r

registration, and "underlying register" and "underlying
registration" shall be construed accordingly.
(2) Article 76 shall be construed for the purpose of this Part o f
this Act, as if for the words " If the master or owner" there we re
substituted the words "If the master or charterer or owner".
