31. A widow whose husband satisfies the relevant contribution
conditions as provided under article 17 on the date of his deat h, or
whose husband died as a result of personal injury caused by an
accident arising out of or in the course of his employment or s elf-
occupation, or deemed to be so in accordance with the provision s of
article 28, or as a result of an industrial disease as is refer red to in
the said article 28, shall be entitled to a Widow’s Pension at the
pertinent rate shown in the Twel fth Schedule to this Act, or to a
Survivor’s Pension; and where this widow has the care and custo dy
of a child of her late husband or the care of a child in respec t of which
an allowance is paid in accordan ce with article 76A, her rate o f
pension under this article shall be increased in respect of eac h such
child by -
(a) the applicable additional allowance in accordance with
the Twelfth Schedule to this Act; or
(b) the applicable additional allowance in accordance with
the provisions of the Twelfth Schedule and the child or
children of the widow or widower concerned have not yet
reached the age of twenty-three (23); sohowever that
where a widow or widower is entitled to an increase in
their pension rate in accordance with this paragraph such
widow or widower shall not be entitled to the increase
referred to in paragraph (a).
Provided that, notwithstanding the provisions of
paragraphs (a) and (b), with effect from the 6 th January

2020, the applicable additional allowance in accordance
w i t h t h e p r o v i s i o n s o f i t e m I o f t h e T w e l f t h S c h e d u l e
shall still be paid to a widow or widower, even if such
widow or widower is in an insurable employment or self-
occupation and such child has not yet reached the age of
eighteen (18).
