Malta Financial Services Authority Act (Cap. 330), article 16A

16A. (1) The Authority shall, on an annual basis, contact the office of the Attorney General and the Commissioner of Police and seek information about any criminal sanctions imposed for any breaches of any provisions of any Act or regulations transposing MiFID. The office of the Attorney General and the Commissioner of Police shall co-operate with the Authority and shall, where relevant, send the Authority a copy of the final judgement in relation to any criminal sanctions imposed. The Authority shall submit such copy of the final judgement to the European Securities and Markets Authority (ESMA). (2) The Authority shall, on an annual basis, contact the office of the Attorney General and the Commissioner of Police and ask for anonymised and aggregated data regarding all criminal investigations undertaken and all criminal sanctions imposed for any breaches of any provisions of any Act or regulations transposing MiFID.
