12. (1) A trust may continue until the one hundred and twenty- fifth anniversary of the date on which it came into existence a nd, unless sooner terminated, shall then terminate. (2) Subarticle (1) shall not apply to a trust for a charitable purpose, to a unit trust or to a r etirement scheme licensed in terms of the Retirement Pensions Act and set up as a trust.
