Trusts and Trustees Act (Cap. 331), article 38C
38C. Without prejudice to any other obligations arising under
any other law, a trustee may apply to the Authority for directi ons
concerning the manner in which he may or should act in connecti on
with any matter concerning the trust or its property when such
matter relates to the fulfilment of his obligations relating to the
prevention of money laundering. Any bona fide communication or
disclosure made in terms of this article shall not be treated a s a
breach of the duty of professional secrecy or any other restric tion,
whether imposed by statute or ot herwise, upon the disclosure of
information and any information disclosed in terms of this arti cle
shall be used only in connection with investigations of money
laundering.
Payment of costs. 39. The costs and expenses of and incidental to an application
to the court under this Act shall be paid out of the trust prop erty or
be borne and paid in such other manner or by such other person as
the court may order.
