16. (1) Save as otherwise expressl y provided, all penalties which may be imposed under this Act shall be imposed by the Commissioner and shall be paid to him, and all actions for the recovery of any duty due and of any penalty incurred under this Act shall be brought by the Commissioner before the courts of civil jurisdiction, and the provisions of article 60A shall apply wit h regard to any such penalty or duty. (2) No proceedings, however, shal l be instituted against any defaulter who, within fifteen days from an intimation to that e ffect made to him by the Commissioner, pays the duty due on the document together with the minimum of the penalty due in accordance with the provisions of this Act. (3) The provisions of sub-article (2) shall not be applicable in the cases to which the proviso to article 11 applies; or where, in the opinion of the Commissioner, the default would not be adequatel y punished by the application of the penalty in its minimum.
