Investment Services Act (Cap. 370), article 30
30. (1) Expatriate officers and employees of any licence
holder and the licence holder sha ll be exempt from the provisio ns
of the Social Security Act , in respect of remuneration paid or
attributed to such officers and employees by the licence holder for
services rendered exclusively in a managerial capacity or in a
function requiring special expertise which is not generally
available in Malta.
(2) In order to obtain the exemption provided for by sub-article
(1), the licence holder shall a pply to the Department for Socia l
Security identifying the officers and employees concerned toget her
with such proof as the department may require that the conditio ns
of that sub-article are satisfied.
(3) Personal belongings and effects of an expatriate officer or
employee of a licence holder impor ted by him into Malta, not la ter
than six months from his first taking up residence, shall be ex empt
from customs duty:

Provided that duty shall become payable on anything
imported free of duty and subsequently sold, assigned or otherw ise
transferred to a person resident in Malta.
(4) Furniture, equipment and other material required by a
licence holder and imported into Malta for its own use and purp ose
shall be exempt from customs duty:

(5) For the purposes of this article, "expatriate" means an
individual who is not a national of Malta, who has been posted to
Malta from abroad or recruited di rectly from abroad in order to be
employed by a licence holder, whose mission in Malta is of a
temporary nature and who has maintained the centre of his
economic interests outside Malta.
