347. In the event of an increase in the issued share capital made to pay the shareholders of the companies being acquired in orde r to give effect to an amalgamation, article 73(4), (5) and (6) shal l not apply where an independent expert’s report on the draft terms o f merger is drawn up. Written report to shareholders to be drawn up by one or more experts. Amended by: IX. 2008.33.
