Employment and Industrial Relations Act (Cap. 452), article 80
80. (1) In giving any award, decision or advice the Tribunal
may give consideration to the social and economic policies and to
the principles of social justice prevailing at the time of its
pronouncement if it considers that these are relevant to the
determination of the case before it.
(2) Where any matter b efore the Tribunal c oncerns or relates to
public officers the Tribunal shall abstain from taking cognizan ce of
any matter which is within the functions of the said Commission .
(3) Where the matter before the Tribunal concerns or relates to
persons employed with bodies cor porate established by law and
managed by a board or other body appointed by the Government or
to persons employed with companies in which the Government has
a controlling interest, any awar d or decision of the Tribunal s hall,
where the Tribunal considers tha t it is appropriate, take into
account the maintenance of due relativity between the terms and
conditions of those employees an d the terms and conditions of
public officers.
(4) The Tribunal shall not make any award or decision which is
inconsistent with any enactment, or other instrument having the
force of law, regulating wages and other terms and conditions o f
employment.
