Environment Protection Act (Cap. 549), article 13
13. (1) Where any member of the Authority, or an officer of
the Authority, or a consultant, advisor or other person engaged by
the Authority, has any interest in, or material to, any matter which
falls to be consid ered by the Author ity, he shall -
(a) disclose to the Authority the nature of his interest at
the first meeting of the Authority after such interest is
acquired or in advance of any consideration of the
matter, whichever is the earlier, and in accordance
with directives issued from time to time by the
Authority;
(b) neither influence nor seek t o influence the processing
and the decision in rel ation to such matter;
(c) take no part in any consider ation of such matter; and
(d) not attend nor participate in any meeting on such
matter.
(2) Where a question arises as to whether or not a course of
conduct, if pursued by a person, would constitute failure by hi m to
comply with the requirements of sub-article (1), the question s hall

be determined by the Authority and the decision and its motivat ion
shall be recorded in the minutes of the meeting during which th e
decision was taken and such person to be duly informed.
(3) Where a disclosure is made to the Authority pursuant to
sub-article (1), particulars of th e disclosure sha ll be recorde d in the
minutes of the relative meeting.
(4) Without prejudice to the provisions of sub-article (6) of ar ticle
6, where a person to whom sub-ar ticle (1) applies fails to make the
required disclosure, the Authority shall decide the appropriate
action to be taken which may include the removal from office or
termination of the contract of the person concerned.
