Environment Protection Act (Cap. 549), article 7
7. (1) The Authority shall be a body corporate having a
distinct legal personality and shall be capable, subject to the
provisions of this Act, of entering into contracts, of acquiring,
holding and disposing of any kind of property for the purposes of
its functions, of suing and being sued, and of doing all such t hings
and entering into all such transactions as are incidental or
conducive to the exercise or performance of its functions under this
Act, including the lendi ng or borrowing of money.
(2) The legal and judicial representation of the Authority shall
vest in the Chairperson:
Provided that the Authority may appoint any one or more of
its other members or any one or m ore of its officers to appear in the
name and on behalf of the Authori ty in any proceedings and in a ny
act, contract, instrument or other document whatsoever, or in t he
case of any vacancy in th e post of Chairperson.
(3) In the absence of the Chairpe rson, or if the Chairperson is
unable to perform the functions of his office, whether under th is or
any other provision of this Act, any one of the deputy chairper sons
shall perform those functions a nd shall rotate the chairpersons hip
of the Authority between t hem as far as practical.
