78. Subject to the provisions of regulations made under this Act, and without prejudice to the Authority’s powers set out in article 77, when an operation or a site is subject to a stop or der or to a compliance order, and the provisions of the said stop order o r compliance order are not abided with, the operation or site may be subject to a daily fine that starts accruing from the date of t he first notification of the stop order or compliance order to any of th e parties to whom the order is ser ved according to the provisions of article 76. Any person subject t o a stop order who fails to com ply with the said order, or when a compliance order has not been appealed or where a compliance order has been appealed but has been confirmed, as the case ma y be, and the person concerned subject to a compliance order fails to comply with the said ord er within the period therein prescr ibed, such person shall be liab le to a maximum penalty of not more than one hundred and fifty euro (€150) for every day the default continues after the expiration of the said period as the Authority may prescribe under the said regulations; and the Authority may recover such penalty from th e said person as a civil debt owing to it.
