Data Protection Act (Cap. 586), article 24
24. (1) There shall be a tribunal to be known as the
Information and Data Protection Appeals Tribunal, referred to i n this
Act as ''the Tribunal'', having the functions and powers assign ed to it
by this Act or by any other law.
(2) The Tribunal shall consist of a chairperson and two other
members appointed by the Minister.
(3) The chairperson shall be an advocate with a minimum of
twelve years legal experience a nd shall have the qualifications ,
experience and skills, in particular in the area of the protect ion of
personal data, required to fulfil his role.

shall be persons who, in the opinion of the Minister, equally r epresent
the interests of data subjects on the one hand, and of data con trollers
and data processors on the other, and who have the qualificatio ns,
experience and skills, in particular in the area of the protect ion of
personal data, required t o fulfil their roles.
(5) The chairperson and other members of the Tribunal shall
hold office for a period of three years and cannot be removed d uring
their term of office except on grounds of proved inability to p erform
the functions of their office, whether arising from infirmity o f body
or mind or any other cause, or proved misbehaviour.

(6) A member of the Tribunal may be challenged or abstain
for any of the reasons for which a judge may be challenged or a bstain
in accordance with article 734 of the Code of Organization and Civil
Procedure. In any such case the Minister shall appoint a person,
having the qualifications of the member challenged or abstainin g, to
sit as a member of the Tribunal in substitution of the said mem ber.
(7) A member of the House of Representatives or of a local
council, a judge or a magistrate , or an officer in the public s ervice
shall be disqualified from being appointed or continuing to be a
member of the Tribunal for so long as he holds that office.
(8) The Minister shall also designate a person to serve as
secretary to the Tribunal.
