3. (1) With a view to protecting the public against the risks which arise in cases where the drivers of motor vehicles are suffering from excessive fatigue, the Minister on the advice of the Authority for Transport in Malta may make orders prescribing th e continuous periods for which any person may drive or cause or permit any person employed by him or subject to his orders to d rive any class of motor vehicle which may be specified in any such order. (2) Any order made under this ar ticle may be revoked or varied by a subsequent order. (3) Any person who acts in contravention of any order made by the Minister under this article shall, on conviction, be liable to a fine ( multa ) not exceeding forty-six euro and fifty-nine cents (46.59): Provided that it shall be a va lid defence to any charge under this article if the person charged proves to the satisfaction o f the court that the contravention was due to unavoidable delaying th e completion of any journey, arising out of circumstances which h e could not reasonab ly have foreseen.
