Criminal Code (Cap. 9), article 225
225. (1) Whosoever, through imprudence, carelessness,
unskilfulness in his art or profession, or non-observance of
regulations, causes the death of any person, shall, on convicti on, be
liable to imprisonment for a term not exceeding four years or t o a
fine (multa) not exceeding eleven thousand and six hundred and forty-
six euro and eighty-seven cents (€11,646.87).
(2) Where the offender has caused the death of more than one
person or where in addition to causing the death of a person th e
offender has also caused bodily harm to another person or other
persons the punishment shall be that of imprisonment of a term of
up to ten years.

(3) Where an offence against sub-article (1) or (2) is committed
by reason of the offender having driven a motor vehicle while u nder
the influence of alcohol or drugs, a minimum punishment of thre e (3)
years imprisonment shall apply in every case, and the court sha ll not
apply the provisions of article 21 of this Code or the provisio ns of the
Probation Act or the provisions of the Drug Dependence (Treatment
not Imprisonment) Act :

Provided that in this article "drug" shall have the same
meaning as assigned to it in article 2 of the Dangerous Drugs
Ordinance and in article 118A of the Medical and Kindred
Professions Ordinance .
