Criminal Code (Cap. 9), article 247
247. (1) Saving the provisions of article 245, where, in
consequence of the abandonment or exposure of the child, such
child dies or sustains a bodily injury, the offender shall be d eemed,
in the first case, to be guilty of wilful homicide, and, in the second
case, to be guilty of wilful bodily harm, and shall be subject to the
provisions relating to homicide and bodily harm respectively; b ut
the punishment shall be diminished by one degree.

(2) Where the abandonment or the exposure of a child as
provided in this article shall not have taken place under
circumstances of manife st danger either to the life or to the p erson
of the child so abandoned or exposed, the punishment shall be
diminished by two degrees:
Provided that where the punishment prescribed in sub-

articles (1) and (2), be not hea vier than the punishment prescr ibed
in the last preceding article, the offender shall, on convictio n, be
liable to the punishment prescribed in the latter article, incr eased
by one degree.
