310B. The offences under this Sub-title shall be deemed to be offences even when committed outside Malta and, without prejudice to the provisions of article 5, the criminal action t herefor may also be prosecuted in Malta according to the laws thereof against any person who commits or participates in the offence a s provided in this Code - (a) when the offence took place, even if only in part, in Malta or on the sea in any p lace within the territorial CRIMINAL CODE [CAP. 9. 165 jurisdiction of Malta; or (b) when the gain to the prejudice of another person has been received in Malta; or (c) when a person in Malta knowingly assisted or induced another person to commit the offence; or (d) when the offender is a Maltese citizen or a permanent resident in Malta and the fact also constitutes an offence according to the laws of the country where it took place: Provided that for the purposes of this paragraph "permanent resident" shall have the same meaning assigned to it by article 5(1)( d). Possession, making or supplying etc., of articles for use in fraud. Added by: XXIV .2014.37. 310BA . (1) Whosoever is found to be in possession or has under his control any article for use i n the course of or in connecti on with any fraud, shall be guilty of an offence and shall, on convicti on, be liable to imprisonment for a term for a term from six months to three years and to the forfeiture of the said articles. (2) Whosoever makes, adapts, supplies or offers to supply any article - (a) knowing that it is designed or adapted for use in the course of or in conn ection with fraud, or (b) intending it to be used to commit, or assist in the commission of, fraud, shall be guilty of an offence and shall, on conviction, be liab le to imprisonment for a term from twelve months to five years and to the forfeiture of the said articles. (3) For the purposes of this article: "article" includes any document, program or data held in electronic form; and "document" shall have the mean ing assigned to it by article 558(2).
