326. (1) Whosoever shall wilfully - (a) break or block the pipes or conduits of any public aqueduct, or in any other manner impede or divert the course of the waters or otherwise damage any part of such aqueduct; (b) break any public cistern, well or aqueduct, or foul the water thereof; (c) damage any electric machinery or cable, or cause the loss of elect ric current; (d) damage any conduit or par t of the public sewer; (e) cut, break, throw down, destroy, damage or remove any battery, machinery, w ire, cable, post or other matter, or thing whatsoever, being part of or being used or employed in or about any electric or magnetic telegraph, with or without wires, or in the working thereof, or do anything which prevents or obstructs in any manner whatsoever the conveyance of any message; (f) damages or breaks any part o f any energy m eter, or the seals thereof, or any part of any apparatus or cables used for the supply of electri city, or the seals thereof; (g) cut, break, throw down, destroy, damage, remove, t a m p e r o r c o n n e c t w i t h , a n y p a r t o f a n y a p p a r a t u s , duct, pole, cabinet, wire, cab le or other matter or thing whatsoever, being part of or being used or employed in the cable television network or in the working thereof or for the supply of the cable television service, shall, saving any higher punishment to which he may be subject under the last preceding article, be liable, on conviction, to imprisonment for a term not exceeding two years: Provided that no proceedings s hall be instituted in respect of any offence under paragraphs ( c), (e) and (f) except on the complaint of the injured party. (2) Whosoever shall, even without any malicious intent, - (a) touch any telegraph wire or place or throw anything upon any battery, machinery, wire, cable or other matter or thing mentioned in sub-article (1)( e), or do 180 CAP . 9.] CRIMINAL CODE anything in proximity to such telegraph wire in such manner as might damage such wire, or prevent or obstruct the conveyance or delivery of any message; or (b) fish in any place in which the Minister responsible for electricity, with a view to preventing damage to any submarine telegraph cable, shall have declared fishing t o b e a b s o l u t e l y p r o h i b i t e d , o r f i s h w i t h a n y n e t o r other implement, the use of which shall have been for the same purpose prohibited by the Minister responsible for electricity; or (c) do anything described in sub-article (1)( g), shall, on conviction, be liable to the punishments established for contraventions.
